Mr Lim Heng Seng will guide and provide each participant with a comprehensive coverage on the subject of dismissals of employees and the recourse to the statutory remedy of reinstatement on the complaint that the dismissal is without just cause or excuse. This intensive two-day workshop will teach and impart knowledge on the important aspects of the subject encompassing, the legal framework for the basis of the claim for reinstatement, the several ways dismissals are effected, the grounds and conditions under which the employment relationship can be brought to an end, the various ways in which the exercise of managerial prerogatives can be challenged on the grounds of unfair practice and the remedies that can be awarded to an employee held by the Industrial Court to have been dismissed without just cause or excuse. The jurisprudence on the subject is derived from case laws and there will be extensive reference to cases to enable participants to understand the rationale as well as to illustrate the application of the principles.

Your Workshop Leader
Mr Lim Heng Seng holds a Bachelor of Laws (Hons.) degree from the University of Malaya and a Master of Laws degree from the University of London. He was admitted to the Malaysian Bar as an Advocate and Solicitor of the High Court of Malaya in 1987. He possesses a wide and varied experience having served in various capacities in the Judicial and Legal Service between 1976 and 1999. Among the positions held, he was Head of Arbitration Unit and Deputy Head of Civil Litigation Division in the Attorney General’s Chambers. He was a Chairman of the Industrial Court, Malaysia between 1994 and 2003 and has also served as a Chairman in the SOCSO Appellate Board from 1997 to 2003.
Mr Lim at present is a Partner at Lee Hishammuddin Allen & Gledhill and is head of Industrial Relations and Employment Law Practice in the firm.
Other positions held by him include Advisory Editor on “Malaysian Court Forms”, Malayan Law Journal, 1996. He is also the author of “Assessment of Damages in Personal Injury and Fatal Accident Claims”, a prescribed textbook for the Certificate in Legal Practice Examination conducted by the Qualifying Board. He sits on the Editorial Advisory Board of the Industrial Law Report.
